1. Acceptance of Terms
By accessing or using PickUp (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. PickUp is operated by LumyxTech Ltd.
2. Service Description
PickUp is a pickup-only ordering platform. Customers browse merchants, place orders, and pay online in advance. Orders are then collected in person at the merchant's location. PickUp does not offer delivery services, table reservations, or in-store cash payments.
3. User Accounts
You must be at least 18 years old to create an account. Your phone number serves as your account identifier. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.
4. Orders and Payment
All orders are prepaid at the time of placement via Stripe, our secure payment processor. Accepted payment methods include credit/debit cards, Apple Pay, and Google Pay. Prices are displayed in New Shekel (ILS). By placing an order, you authorize the charge to your selected payment method.
5. Cancellation and Refunds
You may cancel an order within 5 minutes of placement, provided the merchant has not yet begun preparation. Once a merchant starts preparing your order, cancellation is no longer available. Approved refunds are processed through Stripe and typically appear within 5–10 business days depending on your bank. No refunds are issued for orders marked as NO_SHOW (where the customer failed to collect within the pickup window).
6. Pickup Window
You will receive a notification when your order is ready. You must collect your order within 30 minutes of the ready notification. Orders not collected within this window will be marked as NO_SHOW. PickUp is not responsible for any inconvenience caused by failure to collect on time.
7. Merchant Content
Product listings, prices, availability, preparation times, and dietary information are provided by merchants and are their sole responsibility. PickUp does not warrant the accuracy of merchant-provided information and is not liable for any discrepancies between listed and actual products, prices, or preparation times.
8. Prohibited Conduct
You agree not to: place fraudulent orders, share your account with others, attempt to circumvent payment systems, use automated tools to access the Service, or engage in any conduct that disrupts or damages the Service or other users' experience.
9. Intellectual Property
The PickUp name, logo, and all content on the platform are the intellectual property of LumyxTech Ltd. You may not reproduce, distribute, or create derivative works without our express written permission.
10. Limitation of Liability
To the fullest extent permitted by applicable law, LumyxTech Ltd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to food quality, allergen information, merchant delays, or technical interruptions.
11. Changes to Terms
We may update these Terms at any time. Material changes will be notified via the app or email. Continued use of the Service after any changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by applicable law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Jerusalem, Palestine.
